Payment, Shipping and Returns
All orders you place through thatsmyspot.com.au Pty Ltd via our web site are subject to confirmation and acceptance by us.
All prices and transactions are quoted in and processed in Australian Dollars (AUD$)
We currently accept the following payment types:
- credit card transactions through our encrypted and secure merchant account, or
- direct deposit into our bank account.
At this time, we are unable to accept COD charges.
We will use our best endeavours to ship your orders within 72 hours from the time we receive your payment. Generally we have all items in stock, however, if there is a very high volume of goods that you require, we may need a longer lead time. If this is the case, we will email you to advise when you should expect your shipment to arrive.
If you pay us by direct Deposit, please allow 24 – 48 hours for the funds to arrive in our bank account. Once we receive payment, we will then ship within 72 hours.
We generally use Australia Post and a freight forwarding company for delivery of our products. We will ensure that all our products are sent to you in good condition and packaged correctly, however we cannot guarantee the condition of the product at arrival at your end.
We offer two methods of shipping, Australia Post Regular Parcel Post and Courier. Shipping costs are calculated at the checkout prior to finalising your purchase.
For large orders or if there is an item you would like delivered urgently, please contact us before placing your order so that we can calculate the most cost effective shipping method for you.
At this stage, we will only ship internationally to New Zealand.
For delivery to countries outside Australia, we use Australia Post International Parcel Post air mail and economy air mail servies. Please contact us at email@example.com, prior to finalizing your international purchase, and we will advise of the most cost effective shipping costs.
We know and want you to be extremely satisfied with your thatsmyspot.com.au purchases. If you buy something from us and it is not what you expected, please return the item to is unused or unopened within 14 days. We will then offer you either an exchange of the item or a full refund excluding shipping costs.
Images and Graphics
At thatsmyspot.com.au we aim to include up to date images and/or graphics of all of the goods on this web site. However, our picture of the products may vary slightly from the actual goods. We recommend you read the labels on the goods carefully before using.
Updates to our products and website
By either registering in our thatsmyspot.com.au shop, purchasing goods from us or subscribing to our newsletter, you agree to us sending you information updates about our products and website from time to time. If you wish to opt out of receiving such information, please reply to us with the word “unsubscribe” in the subject line email.
All purchases, and these terms and conditions, are subject to and governed by the laws of New South Wales, Australia.
Exclusion and Limitation of Liability
TO THE FULL EXTENT PERMITTED BY LAW, thatsmyspot.com.au HEREBY EXCLUDES ALL CONDITIONS AND WARRANTIES NOT EXPRESSLY SET OUT HEREIN. EXCEPT AS SPECIFICALLY SET OUT ELSEWHERE IN THIS AGREEMENT, THATSMYSPOT MAKES OR GIVES NO EXPRESS OR IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ARISING FROM A COURSE OF DEALINING, USAGE OR TRADE PRACTICE, WITH RESPECT TO ANY GOODS OR SERVICES PROVIDED UNDER OR INCIDENTAL TO THESE TERMS OR CONDITIONS.NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US, OUR REPRESENTATIVES OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THE EXPRESS WARRANTIES HEREBY GIVEN, AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE.
Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of any products purchased by you from thatsmyspot.com.au shall be limited to the charges paid by you in respect of the goods which are the subject of any such claim and provided that you notify us of any such claim within 14 days of it arising.
In the event that this agreement constitutes a supply of goods or services to a consumer as defined int he Trade Practices Act 1974 or any other national, state or territory legislation (the Acts) nothing contained in this agreement excludes, restricts or modifies any condition, warranty or other obligation in relation to this agreement and the goods and you,where to do so is unlawful. To the full extent permitted by law, where the benefit of any such condition, warranty or other obligation is conferred upon you pursuant to any of the Acts, our sole liability for breach of any such condition, warranty or other obligation, including any consequential loss which you may sustain or incur, shall be limited (except as otherwise specifically set forth herein) to the replacement of the goods or the supply of equivalent goods or payment of the cost of replacing the goods or acquiring equivalent goods, or the repair of the goods or payment of the cost of having the goods repaired.
